Hiring a lawyer is one of the most consequential decisions in any legal matter. Since the Bharatiya Nyaya Sanhita (BNS), BNSS and BSA came into force on 1 July 2024, it also helps to find someone fluent in the new framework. Here is a practical checklist to help you decide who to engage — whether through this directory or anywhere else.
1. Match the specialisation to your case
A property dispute, a bail application and a cheque-bounce matter call for different expertise. For an arrest or FIR, look specifically for a criminal-law practitioner who regularly appears in the relevant Magistrate, Sessions or High Court — not a generalist.
2. Confirm Bar Council enrolment
Every practising advocate in India holds an enrolment number with a State Bar Council. It is reasonable to ask for it and to verify the lawyer is entitled to practise. Genuine professionals share this readily.
3. Ask about BNS/BNSS familiarity
The section numbers changed in 2024. A good advocate can explain how your matter maps from the old IPC/CrPC to the new BNS/BNSS provisions — and what, if anything, changed in procedure, bail or punishment.
4. Get the fee arrangement in writing
Clarify whether the fee is per hearing or per stage, what is included, and how out-of-pocket expenses are handled. A clear written understanding upfront prevents disputes later.
